1. General Provisions
These Terms and Conditions of Sale apply to the sale of all products purchased through the website www.posillipodolceofficina.com.
The use of the distance-selling service described in these Terms and Conditions of Sale is reserved for consumers, understood as natural persons acting for reasons unrelated to sales, business or professional activities. Products are also sold to companies, which must provide their VAT numbers so that we can issue sales invoices.
The language used to draw up the original contract is Italian.
Customers are required to carefully read these Terms and Conditions of Sale, made available on our Website, and to retain them for future reference pursuant to Article 12 of Legislative Decree No. 70 of 9 April 2003.
Contracts concluded through our Website are governed by Italian law and, in particular, by Legislative Decree No. 206 of 6 September 2005 (“Consumer Code”) and by Legislative Decree No. 70 of 9 April 2003 (hereinafter, “Ecommerce Decree”).

3. Product Information
Information relating to Posillipo Dolce Officina Products sold through our Website are available, with their relative product codes, on our Website.
The aforementioned information is provided in accordance with Articles 52 and 53 of the Italian Consumer Code.
4. Prices
Product prices include all taxes and duties. Delivery costs are displayed separately. All prices are in Euros.
5. Product Orders
Essential Product characteristics and prices are listed on the Product offer pages.
To purchase Products, Customers must complete and send an electronic order form to Posillipo Dolce Officina, following the instructions on our Website. Customers must add Products to their “basket” and read the Terms and Conditions of Sale, making particular reference to delivery costs, the methods of exercising their right of withdrawal, and the Privacy Policy. After doing so, Customers must choose their desired payment method and click on the “send order” button.
Before submitting their purchase order, Customers will be given the opportunity to correct any data entry errors using the appropriate modification procedure on our Website. In particular, Customers may change Product quantities by adding or deleting Products to/from their online basket.
By sending an order, Customers acknowledge and declare that they have read all the information provided during the purchase procedure and fully accept the Terms and Conditions of Sale.
Customers will be given the opportunity to view and track the status of their order by navigating to the “Orders” section of their online account.
Posillipo Dolce Officina reserves the right to evaluate the acceptance of orders received.
Posillipo Dolce Officina will notify Customers if we are unable to accept the orders received within 30 days from the day following the day on which said Customer placed his or her order with Posillipo Dolce Officina, and will refund any payments already made by said Customer to pay for supply.
6. Payment Methods
Customers may pay for their Products and the related delivery charges by PayPal or credit/debit card.
Posillipo Dolce Officina accepts payments using the following credit and debit cards:

Transactions will be charged to Customer credit and debt cards only after
a) credit card details have been verified
b) debit authorisation has been received from the Customer’s card issuer
c) product availability has been confirmed by Posillipo Dolce Officina
7. Order Receipt Confirmation
In compliance with the provisions of Article 53 of the Italian Consumer Code, when executing a contract, Customers will receive email confirmation that the purchase order has been received. Said confirmation will contain a summary of the Terms and Conditions of Sale, the general characteristics of the product(s) ordered, the price, the amount paid, the option to exercise the right of withdrawal – with an indication of the times and methods for returning product(s) – the geographical address for submitting complaints, and information on assistance services and existing sales guarantees.
8. Invalid Orders
No contract is to be considered concluded between Posillipo Dolce Officina and its Customers if Posillipo Dolce Officina has reasonable grounds to believe that a Customer is not operating on the basis of his or her effective and genuine interest in purchasing products, or that said Customer is abusing the right of withdrawal recognised by Article 12 below.
In such cases, orders placed by Customers will be deemed invalid. Posillipo Dolce Officina will send Customers an email attesting to the invalid product order and will refund any product payments and/or fees charged to them.
9. Shipping and Delivery
Purchased products will be delivered to the addresses provided by Customers. In any case, Customers have the right to request that products be delivered to a natural person of their choosing, as long as their residence or address is in Italy. The signature of an adult over 18 years of age will be required at the time of delivery. No deliveries will be made to post office boxes.
Delivery costs are charged to Customers and are clearly displayed on our Website and on order forms.
All purchases will be delivered by express courier (hereinafter, “Courier”) from Monday to Friday, excluding the weekend and national holidays. Posillipo Dolce Officina will not be held responsible for unforeseeable delays.
Posillipo Dolce Officina will send Customers a confirmation email once the Products have been shipped. This email will contain a tracking number, which Customers can use to view their order status and track their shipment on the Courier website.
In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Italian Consumer Code, Products will be delivered within a maximum period of 7 (seven) days from the day after Customers place an order with Posillipo Dolce Officina, unless Posillipo Dolce Officina sends an email – within the same time limit – specifying that the Products cannot be delivered due to their temporary or permanent unavailability. In the event of such communication, Posillipo Dolce Officina will refund any payments already made by Customers for the orders in question.
If a Customer wishes to cancel his or her Order after receiving information from Posillipo Dolce Officina that his or her delivery will be delayed, payments already made by said Customer will be refunded as soon as possible, and no later than 30 ( thirty) days from the day after said Customer placed his or her order with Posillipo Dolce Officina.
In order to deliver goods, either a Customer or a person in charge must be present at the address indicated on the order. Upon delivery of the goods by the Courier, Customers are required to check that the number of packages delivered corresponds with the shipping document and that the packages are intact and have not been tampered with. If Customers notice any damage to packages and/or Products, or that the incorrect number of packages has been delivered, they must immediately notify the Company in writing on the Courier’s proof of delivery. Once the Courier’s document has been signed, the Customer will not be able to raise objections regarding the external appearance of the goods delivered.
Shipping costs vary from a minimum of €7 to a maximum of €15 and are calculated automatically by the system when placing your order, depending on the total weight of the items ordered and/or the destination postcode.
Shipping is free of charge for orders over €180.
10. Absence of the Right of Withdrawal
Given the nature of the products sold on online, the right of withdrawal does not apply to contracts concluded through the website https://www.posillipodolceofficina.com/
11. Product Replacement
Posillipo Dolce Officina intends to provide Customers with the option to replace Products purchased on its Website.
Customers who are not fully satisfied must keep all shipping information as well as the Product’s original packaging and immediately contact Posillipo Dolce Officina using the following email address: contatti@posillipodolceofficina.com.
Costs related to product returns must be paid at the expense of the Customer.
12. Lack of Conformity
If products do not comply with those advertised by Posillipo Dolce Officina, Customers must immediately contact Posillipo Dolce Officina via the following email address: contatti@posillipodolceofficina.com.
The sale of Products is covered by the legal safeguards laid down in Articles 129, 130 and 132 of the Italian Consumer Code. Customers have the right for goods to be repaired or replaced, free of charge, or for Product prices to be lowered, or to terminate their sales contract. Customers lose these rights if they do not report the lack of compliance to Posillipo Dolce Officina within one month of the date on which they discovered the defect. Direct action to assess defects not intentionally concealed by Posillipo Dolce Officina is prescribed, in any case, within twenty-four months of delivery of the goods.
13. Errors
Information relating to Products sold on our Website is constantly updated.
However, we cannot guarantee the complete absence of errors.
Posillipo Dolce Officina reserves the right to correct errors, inaccuracies or omissions, including after an order has been sent, and also to change or update information at any time without prior notice.
14. Applicable Law and Competent Court
These Terms and Conditions of Sale are governed by Italian law and must be interpreted in accordance with Italian law.
Any dispute arising from the interpretation, validity and/or execution of these Terms and Conditions shall be referred to the mandatory jurisdiction of the courts of the customer’s place of residence or domicile, if located in Italy.
